Official Statement Regarding PS3 Circumvention Devices and Pirated Software

Today, Sony Computer Entertainment released the following statement:

Notice: Unauthorized circumvention devices for the PlayStation 3 system have been recently released by hackers. These devices permit the use of unauthorized or pirated software. Use of such devices or software violates the terms of the “System Software License Agreement for the PlayStation 3 System” and the “Terms of Services and User Agreement” for the PlayStation Network/Qriocity and its Community Code of Conduct provisions. Violation of the System Software Licence Agreement for the PlayStation 3 System invalidates the consumer guarantee for that system. In addition, copying or playing pirated software is a violation of International Copyright Laws. Consumers using circumvention devices or running unauthorized or pirated software will have access to the PlayStation Network and access to Qriocity services through PlayStation 3 system terminated permanently.

To avoid this, consumers must immediately cease use and remove all circumvention devices and delete all unauthorized or pirated software from their PlayStation 3 systems.

What this means to you

Circumvention devices and game piracy damage our industry and can potentially injure the online experience for you, our loyal PlayStation customers, via hacks and cheats.

Many PlayStation.Blog readers have asked how we intend to deal with these incidents that they have been reading about in the gaming press, and this is our initial response.

By identifying PlayStation 3 systems that breach our guidelines and terminating their ability to connect to PlayStation Network, we are protecting our business and preserving the honest gameplay experiences that you expect and deserve.

Rest assured, this message does not apply to the overwhelming majority of our users who enjoy the world of entertainment PlayStation 3 has to offer without breaching the guidelines detailed above, and we urge you to continue doing so without fear.

    One person claims to have broken into the PlayStation Network, and what he has found is rather shocking. If his findings are accurate, your credit card information is being sent to Sony as an unencrypted text file, and Sony is watching every single thing you do with your system, keeping detailed records all the while.

    “Sony is the biggest spy ever… they collect so much data. All connected devices return values sent to Sony’s servers,” the hacker said. He claims that Sony knows what controllers you’re using, what USB devices are plugged in, what sort of television you’re using—everything.

    That’s not all: your credit card information is apparently being sent as an unencrypted text file. =

  • all we have is read the fine print?? if you would take th etime to read it you would see its illegal and sony has the right to add or remove software if they chose fit. dd is a idiot and geo is scum. and as for utilizing the system to its fullest dosent mean you can hack it its still illegal no matter how you look at it.let the hackers have their fun let them enjoy their $300 doorstops.

  • If you buy something, you own it. You have the right to do with it as you see fit. That is the law *and* common sense.

  • You have the right to do as you please but not when you’re accessing SONY’s PSN. That is theirs and when you violate the Eula you agree to than you also suffer the consequences.

    Anyway, I see you guys pulling out the whole Terms of Service or whatever, but when I went to the store, they only asked me for money, nothing else.

    I don’t mind either way, I can see what kind of people are saying what. I see “b[r]ick dem hecker ps3 kill dirt trash like dirt”, and that pretty much sums up the conversation anyone could have on a Sony-owned blog (no offense Sony, this is simply a comment area of a significant announcement, not a philosophical meet&greet).

  • no but if sony wanted homebrew that would allow it homebrew leads to pirating games. even if your just running emulators just cause its gameboy or snes its still piracy of game software. and yes the store only asked for money but when you set the ps3 up there is a eula you have to agree to to use the system. yeah sony checks their systems to see if there is illegal code running and thats their right microsoft does the same thing as the wii. im glad to see some people arent ignorant and know what the eula is me and iH3ART_Z0IVIBI3S are at least smart enough to know what can and cant be run on the ps3. but by all means you want homebrew go ahead but dont whine and complain when your account and system get banned. and for the people who complain about lunix there is nothing in the eula saying you have the right to install it. thats how bluray piracy started cause with lunix on the ps3 you could dump blurays to the hard drive.sony is well within their rights to remove the other os. you want lunix get a pc

  • Good maybe they should address the hackers in COD4 now, can’t even play that game online anymore because every game you go into someone is hacking and using aim bots, constant UAV’s and other BS. Seriously something needs to be done. This is a nice start but more needs to be done and fast.

    Completely agree…At least Black Ops hasn’t become a completely broken game yet…I would go back to Battlefield immediately if that happened. Or just pick KZ3 when it comes out. So many good looking FPS games are coming out this year, I can’t keep up!!! Homefront FTW

  • Just give up replying to Einhander138, people. All he’s going to do is call you a “sheep” while claiming that by owning a PS3, he also owns the PSN. (*Psst* The PSN is Sony’s and they lock it down to help keep it secure. And even the dumbest CFW user should have known that by modifying the system software, they wouldn’t be able to use the PSN for much longer. That’s the deal they make when accessing the PSN!)

    And he’s never going to admit that all the hacker’s “noble intentions” only made widespread piracy possible and made cheating 1000 times easier.

  • yeah i stoped playing fps on pc due to hackers and aimbots. cod is a stale game series. Killzone 3 is going to be amazing im good to go got the move got my 50″ 3d tv gettin the sharpshooter when its out too cant wait. Homefront looks interesting but im all about killzone 3 sony just keeps gettin better and better

    Never was a PC gamer, always have been with the consoles. Killzone is going to be pretty legit in my opinion. I have the move as well and am interested to see how it is going to work. Either way if I don’t like the move I will always have my Dualshock 3. No 3D tv though =( It will be awesome with your setup for sure.

  • Hey Sony, Kaz Hirai, Eric Lempel, whoever is listening (I’m expecting no one as usual), please update the PS3 with something useful! It has been so long! I’m sick of asking so consistently. Please stop taking things away and add something for loyal customers! Look at the Playstation.Blog Share once in a while and consider implementing one of the top ideas! And no “Make Killzone 3” does not count as an “Idea in Action.”

    I want to be able to organize my huge list of demos and purchases by letter. When is this coming? What progress are you making on this issue? Why is this not available now after almost four years?

    You STOLE OtherOS from us launch model owners as you’ve advertised that feature before it was released at E3. $618 purchase for a gaming/linux system. You stole that feature back and did nothing to compensate for it. You’re worried about piracy, yet you did the same exact thing and brushed it off as nothing. You didn’t even admit you were wrong. OtherOS isn’t what broke open your system, your own engineers did it; with YOUR tools.

    Second, everybody who is on CFW is not stealing from your precious PS store; it’s impossible to do so and no one is trying to do it anyway. Cheating? Why weren’t you this forceful 2+ YEARS AGO?! COD4 had gamesave hacking way before all of this and YOUR community was asking for you to do something about it; you did nothing. Warhawk… Oh god…

  • Third, the piracy thing again. Developers already know about the “jb” and have been coming up with their own ways to still make revenue and not being childish and just saying “you get no access”. BFBC2 i.e. has the VIP code that lets you play the MP the way it’s supposed to be played. DICE gives the chance for those “pirates” to pay for MP and to not be a pirate; same with THQ. Learn from those guys and capitalize on your market instead of acting all uppity and linking everybody together. CFW DOES NOT EQUAL PIRATE; CFW = New ways for you to make money (If you’d actually sit down and THINK).

    My method instead of banning people: All new games must have a code that activates SP & MP modes included in the book. Those who have cfw and did not purchase the game will still have the option of doing so by purchasing the SP & MP codes from the PS Store; thus monies will still be made. Can’t do that if you cut access to PSN now can you? You’re losing out on an untapped market. Also, people with cfw still legally purchase things from your store. Do you really want to lose that income seeing as how psn just recently became profitable?
